These new educational materials inform providers of these changes and how they need to plan for their implementation. This information is designed for Medicare Fee-For-Service providers; however, it may be of interest to all health care providers. Burgin has been as a member of the Wellmont board of directors since July 2009.&lt;br /&gt;&lt;br /&gt;Outgoing President and CEO Mike Snow, will leave the system later this month to become chief operating officer of Amedisys Inc.&lt;br /&gt;&lt;br /&gt;“Bob’s exemplary record at Mission speaks for itself, and he has demonstrated a keen understanding of the opportunities and challenges facing our hospitals during his tenure on the Wellmont board,” said Roger K. A subset of ARRA is the Health Information Technology for Economic and Clinical Health Act (HITECH Act).  The HITECH Act authorizes a $36 billion investment in Health Information Technology (HIT) and Health Information Exchanges (HIE) to improve quality, care coordination and to lower costs.&lt;/p&gt;&lt;br /&gt;&lt;p&gt;&lt;ul style="list-style: none;"&gt;&lt;br /&gt;&lt;li&gt;The HITECH Act is divided into four parts:&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Subtitle A:  Promotion of HIT&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Subtitle B:  Testing of HIT&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Subtitle C:  Grants and Loan Funding&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Subtitle D:  Privacy&lt;/li&gt;&lt;br /&gt;&lt;/ul&gt;&lt;br /&gt;&lt;/p&gt;&lt;br /&gt;&lt;p&gt;New Privacy and Security rules went into effect on September 23, 2009.  However, HHS will not enforce the new rules until February 22, 2010.  But some states are beginning to enforce the new rules effective immediately.&lt;/p&gt;&lt;br /&gt;&lt;ol&gt;&lt;br /&gt;&lt;lh&gt;Below are four of the major changes to the privacy rules:&lt;/lh&gt;&lt;br /&gt;&lt;br /&gt;&lt;li&gt;Creates new obligations for Covered Entities and their Business Associates and modifies individual rights under the Privacy Rule.&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Creates new civil money penalties and enforcement mechanisms.&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Applies HIPAA Security &amp; Privacy Rule standards to Business Associates as matter of law.&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Requires "notification" after a breach of "unsecured PHI" is discovered by Covered Entity or Business Associate.&lt;/li&gt;&lt;/ol&gt;&lt;br /&gt;&lt;p&gt;The following link will take you to the HITECH/HIPAA Information/Resource page on the Highlands Wellmont Health Network (HWHN) website. Instead, CMS increased the work relative value units (RVUs) for new and established office visits, as well as initial hospital and initial nursing facility visits.&lt;br /&gt;&lt;br /&gt;Recently, CMS released &lt;a href="http://www.cms.hhs.gov/transmittals/downloads/R1875CP.pdf" target="_blank"&gt;Transmittal 1875&lt;/a&gt; and &lt;a href="http://www.cms.hhs.gov/MLNMattersArticles/downloads/MM6740.pdf" target="_blank"&gt;MLN Matters 6740&lt;/a&gt; which provides guidance to practices on how to bill for services for Medicare Part B patients now that consultation codes have been eliminated. CMS announced that the modifier to distinguish the admitting physician from other physicians who may furnish care is “-AI.” The admitting physician should append the “-AI” modifier along with initial visit codes to their claims while other physicians who perform initial evaluations should only bill the appropriate evaluation and management (E/M) code. CMS instructs providers to select the appropriate E/M codes based on the content of services provided and not the level of documentation.&lt;br /&gt;&lt;br /&gt;According to agency, documentation should merely support the level of services provided. CMS advises practices to take time and/or controlling factors into consideration when determining the level of service provided. This newly automated process has significantly increased the number of requests that can be processed daily and allows a prescriber or pharmacist to request information during nights and weekends when the information may be needed the most. &lt;br /&gt;&lt;br /&gt;The prescription monitoring program collects prescription data for Schedule II-IV drugs into a central database which can then be used by limited authorized users to assist in deterring the illegitimate use of prescription drugs. The information collected in this program is maintained by the Virginia Department of Health Professions, and strict security and confidentiality measures are enforced. Only those persons authorized by law can be provided information from the database, and the list of authorized persons is very limited. Prescribers and dispensers may query the database to assist in determining treatment history and to rule out the possibility that a patient is "doctor shopping" or "scamming" in order to obtain controlled substances. &lt;br /&gt;&lt;br /&gt;As of May 13th, 2009, prescribers are no longer required to obtain individual written consent from their patients to receive a PMP Report. A written notice in a public area of your office staring that your practice may utilize the PMP program to obtain patient histories is sufficient. For 2010, the rule requires eligible providers to report an e-prescribing code only when a patient visit generates an e-prescription. The provider only needs to report the code 25 times during the 2010 reporting period, which spans the entire calendar year. The Centers for Medicare &amp; Medicaid Services (CMS) will base incentive payments on the covered professional services furnished by an eligible professional during the reporting year. &lt;br /&gt;&lt;br /&gt;In addition, the number of eligible denominator codes has increased. The resulting Red Flags Rule requires all such entities that have “covered accounts” to develop and implement written identity theft prevention programs to help identify, detect, and respond to patterns, practices, or specific activities – known as “red flags” – that could indicate identity theft.&lt;br /&gt;&lt;br /&gt;The Commission previously delayed the enforcement of the Rule for entities under its jurisdiction until November 1, 2009. The Commission staff has continued to provide guidance to entities within its jurisdiction, both through materials posted on the dedicated Red Flags Rule Web site (&lt;a href="www.ftc.gov/redflagsrule"&gt;www.ftc.gov/redflagsrule&lt;/a&gt;), and in speeches and participation in seminars, conferences and other training events to numerous groups. The Commission also published a compliance guide for business, and created a template that enables low risk entities to create an identity theft program with an easy-to-use online form. FTC staff has published numerous general and industry-specific articles, released a video explaining the Rule, and continues to respond to inquiries from the public. To assist further with compliance, FTC staff has worked with a number of trade associations that have chosen to develop model policies or specialized guidance for their members.&lt;br /&gt;&lt;br /&gt;On October 30, 2009, the U.S. District Court for the District of Columbia ruled that the FTC may not apply the Red Flags Rule to attorneys. Today’s announcement that the Commission will delay enforcement of the Rule until June 1, 2010, does not affect the separate timeline of that proceeding and any possible appeals. These changes include a modification of the reference standard for the drug’s unit dose. &lt;br /&gt;&lt;br /&gt;Manufacturers in the United States and Canada label the amount of heparin included in their products based on USP standards. The changes adopted by the USP for the heparin unit dose match the World Health Organization’s International Standard (IS) unit dose definition that has been in use in Europe for many years. The revised USP reference standard and unit definition for heparin is about 10 percent less potent than the former USP unit.&lt;br /&gt;&lt;br /&gt;A unit is the measure of a drug’s activity in the body. For heparin, a unit dose is the measure of the drug’s ability to block the blood’s natural clotting ability (anticoagulation). Heparin’s potency is determined by the dose of the drug required to produce a specific level of anticoagulation.&lt;br /&gt;&lt;br /&gt;Manufacturers for the U.S. market have begun to make heparin using the new USP standard. The FDA has asked that they not ship this new product to customers until Oct. 8, 2009, or later. The delay will give health care providers and facilities time to learn about the changes and to make adjustments to their pharmacy procedures and dosing practices, according to John Jenkins, M.D. director of the Office of New Drugs in the FDA’s Center for Drug Evaluation and Research.&lt;br /&gt;&lt;br /&gt;“Although the FDA-approved labeling for heparin has not changed, including the recommended doses, it is essential that health care professionals be aware of the potential difference in potency between the old and new vials of heparin when administering the drug,” said Jenkins.  &lt;br /&gt;&lt;br /&gt;Four companies market heparin in the United States. APP, the largest manufacturer, markets heparin in vials; Hospira markets heparin in intravenous bags, vials, and syringes; Baxter markets heparin in intravenous bags, and B. Braun markets heparin in intravenous bags. The FDA has asked that all manufacturers identify their new products to help pharmacies and health care professionals differentiate it from the former product. &lt;br /&gt;&lt;br /&gt;By federal law, prescription and over–the–counter medicines available in the United States must meet USP's public standards, when such standards exist. The revised standards for heparin are contained in a new USP monograph. &lt;br /&gt;&lt;br /&gt;The monograph was revised, in part, in response to a 2007-2008 incident of heparin contamination involving a manufacturing step in China. The contaminated heparin was associated with deaths and other adverse events in the United States. Medicaid Services (CMS) requests your participation in a Town Hall meeting on October 29, 2009, from 2:00 PM to 4:00 PM (Eastern Time). As part of this initiative, Medicare posted information in 2007 and 2008 about the payments it made during the previous year for common and elective procedures and services provided by Hospitals, Ambulatory Surgery Centers (ASCs), Hospital Outpatient Departments, and Physicians.&lt;br&gt;&lt;br /&gt;The Hospital information is posted on the Hospital Compare Website where it can be viewed along with hospital quality information.  The Hospital compare website may be found at &lt;a href="http://www.medicare.gov" target="_blank"&gt;www.medicare.gov&lt;/a&gt;.  &lt;br&gt;&lt;br /&gt;On August 28, 2009, Medicare posted an update to the Ambulatory Surgery Center data. G9142 (Influenza A [H1N1] vaccine, any route of administration) describes the vaccine, while G9141 (Influenza A [H1N1] immunization administration, including physician counseling the patient/family) describes the administration of the vaccine. Both codes become effective on Oct. 1.&lt;br /&gt;&lt;br /&gt;CMS anticipates the H1N1 vaccine will be supplied to providers at no cost, although Medicare will pay for its administration. From the &lt;a href="http://www.cms.hhs.gov/AdultImmunizations/"&gt;CMS adult immunizations Website&lt;/a&gt;, “Medicare will cover immunizations for H1N1 influenza, also called the "swine flu." There will be no coinsurance or copayment applied to this benefit, and beneficiaries will not have to meet their deductible. Cahaba asks that providers follow the instructions below that pertain to your situation:&lt;br /&gt;&lt;br /&gt;• If you file paper claims and need to make a simple correction to your claim, please call our telephone Clerical Error Reopening (CER) line. As the J10 MAC, Cahaba GBA will be responsible for the administration of all Medicare Part A and Part B claims in Alabama, Georgia and Tennessee.&lt;br /&gt; &lt;br /&gt;The Centers for Medicare and Medicaid Services (CMS) needs to change the contractor workload numbers for the Part A and Part B workloads in the states of Alabama, Georgia and Tennessee when workload is transitioned to the J10 A/B MAC.&lt;br /&gt; &lt;br /&gt;Part B Tennessee&lt;br /&gt;J10 MAC Workload No.: 10302&lt;br /&gt;Effective Date: 08/29/2009&lt;br /&gt;Current Contractor No.: 05440&lt;br /&gt; &lt;br /&gt;Tennessee Part B claims submitted to the J10 A/B MAC, Cahaba GBA, after 4:00 p.m. CT (5:00 p.m. ET) on Friday, August 28, 2009 MUST have the new workload/receiver ID, 10302, in segments ISA08 and GS03 as well as in loop 1000B, segment NM109. Also, electronic claim status inquiries (276/277) must have the new workload/receiver ID, 10302, in segments ISA08 and GS03 as well as in loop 2100A, segment NM109. Claims and claim status inquiries sent without the new workload ID WILL REJECT. Please contact your vendor to insure your system is updated. Failure to submit the correct workload/receiver ID will cause your claims to reject during the front-end editing process.&lt;br /&gt; &lt;br /&gt;Electronic Funds Transfer (EFT)&lt;br /&gt;All providers currently receiving payments from CIGNA Government Services via EFT, MUST submit a new CMS-588/EFT form (&lt;a href="http://www.cms.hhs.gov/cmsforms/downloads/CMS588.pdf" target="_blank"&gt;http://www.cms.hhs.gov/cmsforms/downloads/CMS588.pdf&lt;/a&gt;), Authorization Agreement for Electronic Funds Transfer, IMMEDIATELY to avoid an interruption in EFT payment. This is required even if Cahaba GBA’s financial institution is the same as that of CIGNA Government Services. Providers that do not complete and submit the CMS-588/EFT form prior to cutover will not receive Medicare payments.&lt;br /&gt; &lt;br /&gt;Please Note:  If you are a group practice and have multiple physicians within your organization, only one CMS-588/EFT for the group is needed.  A separate CMS-588/EFT for each provider within the group is not required.  Additionally, group practices with multiple locations that are all under the same Tax ID number and have their Medicare payments deposited to one bank account are only required to send in one CMS-588/EFT Agreement.  However, if the Medicare payments for each location are deposited to different bank accounts, a separate CMS-588/EFT form is needed for each location and/or bank account payable to the group practice.  &lt;br /&gt; &lt;br /&gt;If you have not already done so, you MUST submit the CMS-588/EFT form to Cahaba GBA IMMEDIATELY even if you recently updated your information with CIGNA Government Services.&lt;br /&gt; &lt;br /&gt;Completed CMS-588/EFT forms should be sent to:&lt;br /&gt; &lt;br /&gt;Cahaba GBA Provider Enrollment-TN-Part B P.O.
